1. Responsibility of the User

You are solely responsible for:

• All content you stream, upload, transmit, or broadcast
• Compliance with applicable laws, regulations, and platform rules
• Any consequences arising from your use of the Service

BROADCASTLOOP exercises no editorial control and assumes no responsibility for user content or actions.

2. No Warranties – “As Is”

The Service is provided “AS IS” and “AS AVAILABLE”, without warranties of any kind, including:

• Availability, accuracy, reliability, or uninterrupted operation
• Fitness for a particular purpose
• Compatibility with third-party platforms

3. Absolute Limitation of Liability

BROADCASTLOOP is not liable under any circumstances for:

• Direct, indirect, incidental, consequential, special, or punitive damages
• Loss of revenue, profits, data, streams, access, reputation, or business
• Third-party actions, service outages, or technical issues

If liability cannot be excluded by law, it is limited to the minimum amount permitted and never exceeds the amount paid for the specific usage causing the claim.

4. All Payments Are Final

Refunds are issued solely at the discretion of BROADCASTLOOP and will be subject to applicable transaction fees, minimum balance requirements, or compensation for resources already consumed. Exceptions will be made where BROADCASTLOOP is found to have failed to uphold it’s Terms of Service. In case of terms of service violations, any and all refunds are forfeit.

Vouchers are not redeemable for cash and are valid only until their expiration date. BROADCASTLOOP reserves the right to remove voucher credit at its discretion. Any abuse of the voucher system will result in account suspension or termination.

We operate a support desk where we intend to resolve issues. Opening a payment dispute is a violation of these terms and will result in service termination and a $50 chargeback fee.

5. Right to Modify or Terminate

BROADCASTLOOP may, at its sole discretion, at any time and without notice:

• Restrict or terminate user access
• Change features, or usage rules

No liability arises from these actions.

6. Third-Party Services

The Service relies on third-party providers (hosting, payments, analytics, streaming). BROADCASTLOOP is not responsible for their availability, policies, enforcement, or data handling.

BROADCASTLOOP uses third-party infrastructure providers such as Hetzner Online GmbH for servers and related services. The processing/storage and usage of user data by these providers is governed by their own privacy policies and terms, which are independent of BROADCASTLOOP’s policies.

Your use of third-party services is governed by their own terms.

7. Indemnification

You agree to indemnify and hold harmless BROADCASTLOOP from any claims, damages, or legal fees arising from:

• Your use of the Service
• Your content
• Violation of laws or third-party terms
• Claims made against BROADCASTLOOP due to your actions
• The utilization of BROADCASTLOOP services and resources
• Content streamed from your account

8. Acceptable Use and Abuse

You agree to use BROADCASTLOOP in accordance with the intended purpose of the Service. The following constitutes a breach of acceptable use:

• Tampering with, reverse-engineering, or attempting to bypass system protections or security measures.
• Interfering with, overloading, or abusing the Service, servers, network, or infrastructure beyond the limits specified by BROADCASTLOOP.
• Attempting to gain unauthorized access to accounts, data, or systems belonging to BROADCASTLOOP or other users.
• Linking to files from any site exterior to the BROADCASTLOOP environment and it's intended use.

These Terms are governed by applicable law, without regard to conflict-of-law principles.

9. Free Trial

BROADCASTLOOP offers a limited free trial period solely for the purpose of evaluating the Service. The free trial is strictly limited to one use per individual and/or organisation.

• Creating multiple accounts, using false or misleading information, or otherwise attempting to circumvent free trial limitations is strictly prohibited.
• Any account identified as abusing the free trial will be immediately terminated without notice.
• BROADCASTLOOP reserves the right to permanently ban offending individuals, organisations, IP addresses, and associated accounts.
• BROADCASTLOOP also reserves the right to publicly list offending accounts, associated games, and individuals who violate the Free Trial Terms, in order to warn the community and deter further abuse.
• In cases of deliberate or repeated abuse, BROADCASTLOOP reserves the right to pursue recovery of damages, costs, and losses incurred as a result of such abuse, including administrative, infrastructure, and legal costs.

Abuse of the free trial constitutes a material breach of these Terms and may result in legal action where appropriate.

10. Acceptance

By using the Service, you confirm that you understand these Terms, accept full responsibility, and waive any claims against BROADCASTLOOP to the maximum extent permitted by law.
